Thirteen weeks at ten years in a jurisdiction built on turnover
The Northern Territory accrues at 1.3 weeks per year like South Australia — 13 weeks at 10 years, a third more than the six jurisdictions on 0.8667 weeks. The paradox is that the Territory also has the shortest average job tenure in the country: the most generous entitlement sits in the labour market least likely to reach it. The Long Service Leave Act 1981 (NT) opens its conditional pro-rata at 7 years, so an employee made redundant at eight years is paid about 10.4 weeks, while the same employee resigning to take a job interstate is paid nothing. In a workforce that turns over as fast as the Territory's, that distinction decides more final pays than the accrual rate does.
The accrued-weeks column runs a third ahead of the New South Wales, Victorian, Queensland, Western Australian and Tasmanian equivalents because of the 1.3-week accrual. The payout columns follow the standard conditional pattern: redundancy from 7 years, any termination from 10.
Payment on leaving in the Northern Territory
After 7 years: pro-rata on termination for any reason except serious misconduct. After 10 years: 13 weeks. The Territory's remote-area employment adds a wrinkle that the other Acts rarely meet: employment that is genuinely intermittent — wet season shutdowns, rotational rosters into remote communities, fixed-term contracts renewed annually — raises the continuity question on almost every claim. Regular and systematic engagement counts, and a break caused by the employer does not interrupt service. An employee whose contract is renewed each year with the same employer has continuous service, whatever the contracts say individually.
Interstate service and the Territory's mobile workforce
Long service leave follows the employment, not the employee, and it does not aggregate across employers outside a portable scheme. A worker who spends four years in Darwin and six in Perth for different employers has two separate periods, neither of which reaches a threshold, and ends a ten-year career with nothing — the single most common way the entitlement is lost in the Territory. Service with the same employer across state lines is a different matter: it is continuous, and the applicable Act is generally that of the place with the closest connection to the employment. Where that place is the Northern Territory, the 1.3-week accrual applies to the whole of the service, which makes the question worth settling before a claim rather than during one.
NT Build
NT Build administers portable long service leave for the Territory's construction industry, funded by a levy on eligible construction projects. It exists because Territory construction is dominated by large projects with workforces assembled for their duration: without portability almost nobody in the industry would reach 10 years with one employer. Workers register with the scheme and the accrual follows them between employers and between projects. The entitlement is claimed from NT Build, not from the final pay, and it survives the end of the project that generated it — a worker who has moved through four Territory projects in eight years has one continuous balance with the scheme rather than four periods of service that never reached a threshold.
Claims through NT WorkSafe and the courts
NT WorkSafe administers the Long Service Leave Act 1981 (NT), and unpaid entitlements can be recovered in the Local Court. Employers must keep records of service, which for employers of remote and rotational workforces is precisely the obligation most often neglected — and where the records are missing, the employee's own evidence of the pattern of work carries correspondingly more weight. An employee approaching 7 years should request a statement of accrued leave, particularly where the employment has run through several fixed-term contracts.
The rules common to all eight jurisdictions — what counts as continuous service, the rate of pay the leave is paid at, and how leave is taken while employed — are set out in the long service leave guide. The final pay calculator adds the result to redundancy, notice and annual leave.
Frequently asked questions
How many weeks of long service leave in NT?
13.00 weeks after 10 years of continuous service with the same employer, accruing at 1.3000 weeks for every year worked, and continuing at that same rate for each further year. The entitlement comes from the Long Service Leave Act 1981 (NT), not from the National Employment Standards, which is why it differs from state to state — the same career length can produce a materially different payout depending on where the work was performed.
Leaving Northern Territory employment before 10 years: what is paid?
After 7 years: pro-rata on termination for any reason except serious misconduct. After 10 years: 13 weeks. The reason for leaving therefore matters as much as the length of service, and it is judged as at the date of termination rather than reconstructed later. The entitlement sits under the Long Service Leave Act 1981 (NT), so a disputed payment is pursued through the Northern Territory industrial authority and not the Fair Work Ombudsman.
I worked four years in the NT and six interstate. Do I have ten years?
Not unless it was the same employer or a related one. Long service leave accrues with an employer, not across a career, and outside the portable schemes there is no aggregation. Two periods with different employers are two separate entitlements, and neither reaches 7 years here.
Do annual fixed-term contracts break my service in the NT?
Generally not, where they are renewed with the same employer and the work continues in substance. Continuity looks at the reality of the engagement rather than at the form of the contracts. A genuine end of employment followed by a fresh engagement after a real break is a different case.
