Nature of the service

The calculators turn the figures you enter into an estimate of what an employer owes when employment ends, using the National Employment Standards in the Fair Work Act 2009, the long service leave legislation of the state or territory you select and the ATO rules for taxing termination payments. An estimate is not legal, tax or financial advice. Your modern award, enterprise agreement or employment contract can provide more than these minimums and prevails where it does. The site is run independently of the Fair Work Ombudsman, the Fair Work Commission and the ATO. The scope and the omissions of each calculation are listed in the methodology.

Errors and liability

Parameters are revised when the law or the ATO rates change, and the engine is tested against worked examples. Even so, no warranty is given that a result is complete or free of error, and several situations are outside the model, among them casual conversion, transfer of business and dismissal for serious misconduct. The service is supplied as is. As far as the law allows, we are not liable for loss caused by relying on an estimate or by the site being unavailable. These terms do not exclude, restrict or modify any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded. Errors can be reported from the contact page and are handled as the editorial policy describes.

Intellectual property

Under the Copyright Act 1968, the publisher owns the wording of the guides, the page design, the compiled parameter tables and the code. You may quote a short passage if you link to the page it comes from; any wider copying needs our written permission. Acts, regulations and government material keep the licence their publisher attaches to them.

Embedding

The calculator may be placed on another website through an iframe at no charge, as long as the credit link to this site stays visible and the page around it does not present it as a government tool. Details are on the widget page.

We link to Fair Work, ATO, state government and legislation pages so that each figure can be checked at its source. Those pages are outside our control and we are not responsible for them.

Privacy

Calculator entries are processed in your browser and are not sent to us. The privacy policy and the cookies page explain why no cookie is set and how a cookieless Clarity check keeps the site stable.

Personal data and cookies

What you type in the calculators stays in your browser. The site sets Google Analytics audience measurement cookies (_ga, _ga_HWT5E9QXMH, 13 months at most), with no advertising; page stability is monitored with Microsoft Clarity, cookie-free. Law and jurisdiction
